Terms of use

These terms apply to the ViewTile app (“the app”) and to this website. By installing or using the app, or by using the site, you accept them. They are short on purpose: an app with no account and no service behind it does not need a long agreement, and a long one would mostly describe obligations neither side has.
“ViewTile”, “we” and “us” mean the operator named on the legal notice.
What ViewTile is
An app that shows video from IP cameras you already own, over your own network, and lets you adjust those cameras where they allow it. It is a viewer and a configuration tool. It is not a monitoring service, it does not record on your behalf, and there is no server of ours between you and your cameras.
What it is not
ViewTile is not a security or life-safety system and must not be relied on as one. It shows what a camera sends while it is running on your device. It does not alert anybody, does not record on its own — the snapshots and clips you take yourself are saved on your device and nowhere else — and cannot tell you that a camera stopped working while nobody was looking. If you need alarms, recording or guaranteed availability, use equipment built and certified for that.
Your licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for viewing and configuring cameras you are entitled to use. The app is licensed, not sold. You may not copy, modify, distribute, sell or rent it, or reverse-engineer it except where the law expressly allows it despite this clause. The open source components it contains are licensed to you under their own terms (see Open source), which prevail for those components.
On the App Store, Apple’s Licensed Application End User License Agreement also applies, and where the two conflict for an App Store copy, Apple’s terms prevail. On Google Play, the Google Play Terms of Service also apply.
Your cameras are yours
You are responsible for having the right to view, configure and record the cameras you add, and for how you use what you see. Laws about recording people and places, about audio, and about notifying people of cameras differ by country and by situation; ViewTile does not and cannot advise you on them. Do not use the app to reach cameras you are not authorised to reach.
Acceptable use
Use the app and the site lawfully. Do not use them to interfere with networks or devices that are not yours, to circumvent a camera’s access controls, or to send abusive, deceptive or unlawful material to our support address.
Purchases
There is no purchase in the app today. If a paid version is offered, it will be a one-time purchase through the App Store or Google Play, under that store’s terms. Refunds are handled by the store you bought from, under its rules; where a store allows the developer to issue one, ask at the address below and it will be dealt with there. Because there is no account on our side, a purchase unlocks the app on the store account that bought it and cannot follow you between Apple and Google.
Availability and changes
The free features may change between versions: an update may add, alter or remove something, and the release notes say what.
What a purchase unlocks is different. Functionality you paid for stays available to you in the version you bought and in every later version. If a piece of it ever had to be withdrawn — because a platform or a standard removed what it depended on — you would be told beforehand, offered an equivalent where one exists, and where none does, offered a refund of the purchase.
We may stop distributing the app or close this website; an app you have already installed keeps working, because it needs nothing from us.
Test builds
A test build is provided for evaluation, may be incomplete or unstable, may stop working when the test period ends, and is offered without any of the assurances given for a released version. Please do not use a test build for anything that matters.
Warranty and liability
The app and the site are provided as they are and as available, without any warranty — express or implied — that they will suit a particular purpose, work with a particular camera, or run without interruption or error.
To the fullest extent the law allows, we are not liable for any loss or damage arising from using or being unable to use the app or the site, including anything not seen, not recorded, or missed, and including indirect or consequential loss. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the event, and nothing here limits liability for death, personal injury, fraud, or anything else that the law does not allow to be limited.
If you are a consumer, nothing in these terms takes away rights you have under the consumer-protection law of the country you live in, including rights that cannot be limited by agreement.
Apple
For a copy obtained from the App Store: Apple is not a party to these terms and has no obligation to provide maintenance or support for the app. Apple is not responsible for any claim relating to the app, including product-liability, consumer-protection or intellectual-property claims; those are our responsibility to the extent the law allows. If the app fails to conform to a warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a U.S. Government embargo or designated as a “terrorist supporting” country, and not on any U.S. Government list of prohibited or restricted parties.
Open source
ViewTile ships open source components under their own licences, listed in the app under About › Third-party notices. Those licences govern those components. Where a licence requires it, the corresponding source is available on request at the address below.
Trademarks
ViewTile and its logo are ours. Other names on this site belong to their owners; see the legal notice.
Termination
You may stop using the app at any time by deleting it. Your licence ends automatically if you break these terms; the sections on your cameras, warranty and liability, and governing law survive.
Governing law
These terms are governed by the law of the country in which the operator named on the legal notice is established, and disputes go to the courts of that country — except that if you are a consumer, you keep the protection of the mandatory law of the country you live in and may bring a claim in its courts.
Changes to these terms
If these terms change, the date at the top changes, and the release notes of the version they apply to say what changed. Continuing to use a new version after a change means accepting the changed terms; if you do not accept them, do not install that version.
